1. Acceptance of Terms

By accessing or using SimsJourney.com ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service.

2. Digital Product Purchases

All products sold on SimsJourney are digital goods delivered instantly upon purchase. No physical items will be shipped.

Non-Refundable: Due to the digital nature of our products, all purchases are final and non-refundable, except where required by applicable law. Once a digital product or cosmetic item is delivered to your account, you may not request a refund.

If you experience technical issues preventing access to purchased content, please contact support at simsjourneybusiness@gmail.com within 14 days of purchase.

3. Subscription Services

Auto-Renewal: Premium subscriptions automatically renew at the end of each billing period (monthly or yearly, as selected) unless canceled before the renewal date.

Billing: You authorize SimsJourney to charge your payment method on file for the subscription fee at the start of each billing period.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.

No Refunds: Subscription payments are non-refundable after processing. If you cancel mid-cycle, you will not receive a prorated refund, but you will retain access until the end of your paid period.

Access Loss: Upon cancellation or expiration of your subscription, you will lose access to premium features, cosmetics, and other subscriber-only content.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

SimsJourney is not liable for any loss or damage arising from your failure to protect your account information.

5. Intellectual Property

All content on SimsJourney, including but not limited to challenge trackers, cosmetic themes, AI-generated narratives, and software code, is the property of SimsJourney or its licensors and is protected by copyright and other intellectual property laws.

Prohibited Actions: You may not:

• Redistribute, resell, or share access to SimsJourney content or features
• Copy, modify, or create derivative works of our trackers, cosmetics, or software
• Reverse engineer or attempt to extract source code from the Service
• Use the Service for any commercial purpose without written permission

6. User-Generated Content

You retain ownership of any content you create using SimsJourney (such as challenge data, stories, and images). However, by using the Service, you grant SimsJourney a non-exclusive, worldwide license to display, store, and process your content as necessary to provide the Service.

You are solely responsible for ensuring your content does not violate any third-party rights or applicable laws.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMSJOURNEY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

SimsJourney provides the Service "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to SimsJourney in the 12 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason.

Upon termination, your right to use the Service will immediately cease, and we may delete your account data.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Vermont, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Vermont.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
